Terms of Service

1Acceptance of these terms

These terms are an agreement between you and Instantsite (“we”, “us”) covering instantsite.app, the dashboard, the editor, the generator, and every website published through the service.

By creating an account or using the service you accept them. If you do not, do not use Instantsite. Our Privacy Policy explains how we handle information and forms part of this agreement.

2Eligibility and your account

You need an account, and you must be old enough to enter into a binding contract where you live. If you are creating an account for a company, you confirm you are allowed to accept these terms on its behalf.

• Give accurate details, and keep your email address current; it is how we reach you about your account, your billing and your websites.
• Your sign-in credentials are yours to protect. Anything done through your account is treated as done by you.
• Two-factor authentication is available in Settings. We recommend turning it on.
• Tell us immediately at accountassistance@instantsite.app if you think someone else has access.
• Do not share an account, and do not use someone else’s.

3What Instantsite does

You describe your business. Instantsite plans the pages, writes the first draft, chooses a visual direction and assembles a complete website. You then edit it (text, images, sections, pages, colours, fonts and logo) and publish it, either to an address on instantsite.app or to a custom domain on a paid plan.

Hosting and delivery of published websites are included. The features and limits of each plan are shown on the Pricing page, which is the current statement of what a plan includes at the time you buy it.

The service is provided as it is at any given moment. Features are added, changed and occasionally withdrawn (see Availability and changes).

4Plans and the free tier

New accounts start on the Free plan with a 30-day window and no card on file. During it you have the whole Free plan: generate a website, edit it in the full editor and publish it to an instantsite.app address. Free covers 1 website.

When the window ends, managing your websites and domains in the dashboard is locked until you choose a paid plan. Nothing is deleted, and everything becomes available again the moment you upgrade. Because there is no card on file, nothing is ever charged automatically at the end of the free window.

Plan limits are enforced. Creating more websites than your plan allows, or using a feature your plan does not include, will be refused.

5Payment, renewal and tax

Who takes the payment

Stripe. You enter your card on Stripe’s pages; we never receive it.

Currency and tax

Prices are shown in US dollars and exclude tax. Stripe calculates any VAT or sales tax that applies where you are and shows the total before you confirm. You can add a business tax ID at checkout.

Yearly billing

A yearly plan is one payment covering twelve months, taken up front, not twelve monthly charges. The per-month figure shown beside it is that annual price divided by twelve.

Invoices

Every payment produces an invoice, available in Billing in your dashboard.

If a payment fails

Your subscription is marked past due and our payment provider retries it. Paid features may stop working while it is unpaid, and the subscription may end if it is never settled. Update your card in Billing to fix it.

Price changes

We may change prices. A change never applies to a period you have already paid for, and we will tell account holders before a change affects their renewal.

6Upgrades and downgrades

Moving up

Takes effect immediately. You are charged the difference straight away, and the unused part of your current plan is credited automatically by our payment provider.

Switching between monthly and yearly

Also immediate, and starts a new billing period from that day. The unused time on the old cycle is credited the same way.

Moving down

Scheduled, not immediate. You keep the plan you paid for until the end of the current period, and nothing is charged or refunded at the time you ask. The smaller plan takes over at renewal.

Cancelling a scheduled change

You can cancel a scheduled downgrade from Billing at any point before it takes effect.

7Cancellation and refunds

Cancel from Billing in your dashboard whenever you like. There is no cancellation fee and no notice period. Your plan stays active until the end of the period you have already paid for; after that the account returns to Free, with the effects described above.

Cancelling does not produce an automatic refund of the current period: you keep the plan you paid for until it runs out, rather than getting the remainder back. Deleting your account cancels active subscriptions the same way.

Refunds are not issued automatically. If you believe you were charged in error or there are exceptional circumstances, write to accountassistance@instantsite.app and we will review the request. Where a refund is approved, it is returned through the original payment method and a credit note is issued.

Domain registration fees are handled separately (see Domains).

8AI-generated content

Instantsite generates content with a large language model, working from what you write. That means:

• Output can be wrong. It can invent details, misstate facts, and produce claims about your business that are not true.
• Two identical descriptions will not produce identical websites, and we do not guarantee any particular result, structure or wording.
• We make no representation that generated content is accurate, complete, current, or fit for any regulated purpose. It is not legal, medical, financial, tax or other professional advice, and it is not written to satisfy any industry’s disclosure rules.
• Generated text may resemble other text. We do not warrant that generated content is original or that it does not conflict with anyone else’s rights.

9Your content, and who owns what

What you provide stays yours

Your descriptions, text, images, logo, trade marks and business information remain yours. We claim no ownership of them.

The licence you give us

To run the service we need permission to host, store, copy, transmit, adapt and display what you provide: to generate your website from it, to show it in the editor, to publish it at the address you choose and to deliver it to your visitors. You grant us that licence for as long as you use the service, for those purposes and no others. It ends when you delete the content or your account, except for copies already made in backups or required for our records.

You must have the rights

You confirm you are entitled to supply everything you upload, and to publish it. That includes photographs of people, other people’s trade marks and any content you did not create yourself.

The website we generate for you

As between you and us, the text, images and layout of your finished website are yours to use for your business, including after you leave. Third-party material inside it keeps its own terms: stock photography is licensed by the stock provider, and fonts by their foundries.

10Published websites

• Publishing puts a snapshot of your website live. Later edits do not appear publicly until you publish again.
• You can unpublish at any time; the website stops being reachable straight away and the content stays in your account.
• Websites on the Free and Pro plans carry a “Designed by Instantsite” credit in the footer. The Premium plan does not.
• Pre-publish checks look for broken links, empty buttons and misconfigured forms. They are a help, not a guarantee that a website is correct or complete.
• We may unpublish or suspend a website that breaks these terms, that is the subject of a valid legal complaint, or that puts the service or other users at risk. Where we can, we will tell you why first.

11Domains

On a paid plan you can connect a domain you already own, or buy one through Instantsite. Domains bought here are registered with our registrar, Name.com, and are subject to that registrar’s terms and to the rules of the registry for that domain ending.

• Availability is never guaranteed. A domain can be taken between the moment you search and the moment you pay, and a registration can be refused by the registrar or the registry.
• A registration covers one year from the date it is placed.
• Renewal prices can differ from the first-year price, sometimes substantially. Renewal is charged at the price applying at the time of renewal.
• Auto-renew is switched on when you buy, and runs as a separate recurring charge. You can switch it off in your dashboard.
• If a renewal payment fails, or auto-renew is off, the domain can expire. An expired domain can be suspended, deleted, and registered by somebody else. Recovering one may be impossible, or may carry a redemption fee set by the registry.
• Registrar and registry fees are paid out as soon as a registration or renewal is placed, and may not be recoverable even where we would otherwise refund you.
• Keep the details associated with a domain accurate. Registries can suspend a domain over invalid or unverified information.
• A connected domain needs its DNS records pointed at us and kept that way. If you change them, your website stops resolving.

Custom domains are a paid feature. If your account returns to Free, a website published on a custom domain stops being served at that address.

12Acceptable use

Use Instantsite for a real purpose, lawfully. Do not:

• Break the law, or help anyone else break it.
• Try to access another account, another user’s websites, or any part of our systems you have not been given access to.
• Probe, scan, overload or interfere with the service, or work around plan limits, rate limits or the bot checks.
• Upload or distribute malware, or content designed to damage or deceive.
• Scrape or bulk-download the service, or resell access to it, without our written agreement.
• Use the generator to mass-produce websites for spam, link schemes, doorway pages or deceptive advertising.
• Send unsolicited bulk email using addresses collected through a website you publish here.
• Misrepresent your identity, your business, or your relationship with anyone else.

13Content that is not allowed

Do not create, upload or publish content that:

• Is unlawful, or promotes unlawful activity.
• Sexually exploits or endangers children, in any form.
• Infringes copyright, trade marks or other rights, including photographs, logos and text you did not license.
• Harasses, threatens, defames or incites violence or hatred against people or groups.
• Is fraudulent or deceptive: fake businesses, fake reviews, fake credentials, impersonation, phishing, or fake shops.
• Makes medical, financial, legal or safety claims you are not qualified or licensed to make.
• Discloses someone else’s personal information without a lawful basis for doing so.
• Is prohibited by our providers (hosting, payment, email or registrar) whose rules apply to what runs on their infrastructure.

Report abuse to hello@instantsite.app. We do not monitor every website, and we are not obliged to, but we act on what we find and on what is reported to us.

14Third-party services

Instantsite is built on services we do not control: authentication, hosting and content delivery, the AI provider, payments, invoicing, email, stock photography, the domain registrar and analytics. The Privacy Policy lists them and says what each one handles.

Their terms apply to their part of the service, and an outage or a change at one of them can affect Instantsite. Websites you publish may also link to services we have nothing to do with; we are not responsible for those.

15Our intellectual property

The Instantsite platform (the generator, the editor, the section designs, the templates, the design system, the software, the name and the logo) belongs to us and our licensors. Your subscription buys the right to use the service, not any ownership of it.

Do not copy, decompile, reverse-engineer or resell any part of the platform, and do not use our name or logo to suggest we endorse you.

If you send us an idea or a suggestion, we may act on it without owing you anything for it.

16Availability and changes to the service

We may add, change, or withdraw features, and change how the generator or the editor works. If we withdraw something material that a paid plan relied on, we will tell account holders and, where that is the fair outcome, let you cancel.

Keep your own copies of anything you cannot afford to lose. We take backups for our own operational purposes; that is not a data-recovery service for you, and we do not guarantee that any particular version of your content can be restored.

Nothing in the service is a promise about the results your website will produce. We do not guarantee traffic, search rankings, enquiries, customers or revenue.

17Suspension and termination

You can leave whenever you want

Cancel your plan, or delete your account entirely from Settings. Deleting the account cancels active subscriptions, removes your account and your websites, and deletes your record with our authentication provider.

We may suspend or end an account

For a breach of these terms, unlawful use, non-payment, abuse of the service or of other people, or a risk to the service or its providers. Serious cases (anything involving illegal content or an active threat) may be immediate and without notice.

What survives

Ending the agreement does not cancel amounts already owed, and the sections on your content, our intellectual property, disclaimers, liability, indemnity and governing law continue to apply.

18Disclaimers

The service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy or quiet enjoyment.

We do not warrant that the service will meet your requirements, that generated content will be accurate or suitable, that a domain will remain registered, that a website will rank or perform in any particular way, or that defects will be corrected.

Some jurisdictions do not allow certain exclusions. Where that is the case, this section applies only so far as that jurisdiction permits, and nothing here removes a right you have that cannot be waived, including consumer rights.

19Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, lost business, lost goodwill, lost customers, or the cost of substitute services, even if we were told such loss was possible.

Our total liability arising out of or relating to the service, in aggregate, is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Nothing in this section limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, for fraud, and for any consumer right that cannot be excluded where you live.

20Indemnity

You agree to cover our reasonable losses, including legal costs, arising from a claim brought against us because of what you published or uploaded, your use of the service, your breach of these terms, or your infringement of someone else’s rights. We will tell you about any such claim and let you take part in defending it.

21Governing law and disputes

These terms do not limit any mandatory rights or remedies available to you under applicable law. No arbitration procedure is required by these terms.

Before anything formal, please write to accountassistance@instantsite.app. Nearly everything is settled faster that way.

If any part of these terms is found unenforceable, the rest continues to apply, and that part is read as narrowly as necessary to make it enforceable. Not enforcing a term on one occasion does not waive it. These terms, together with the Privacy Policy and anything expressly referenced in them, are the whole agreement between us about the service. You may not transfer this agreement without our consent; we may transfer it as part of a merger, acquisition or sale of the business.

22Changes to these terms

We update these terms as the product changes. The date at the top is the date of the current version.

For a material change (one that affects what you pay, what you are allowed to do, or what happens to your websites) we will notify account holders by email or in the product before it takes effect. Continuing to use the service after that means you accept the new version. If you do not, cancel before it takes effect.
